Terms of Use and Privacy Policy

 

1. Definitions 

  • By using our web site, or by purchasing anything from us, you agree to our terms and conditions

  • If you are under 18 years of age you may not purchase goods from us

  • ‘’Carrier’’ refers to anybody contracted by  to deliver goods from us to you

  • ‘’Our Website’’ is all of the computing hardware and software that makes up our site

  • ‘’Goods’’ refers to anything we are selling on our website

  • ‘’Content’’ refers to any information on our site, published by us, or anybody else with our consent

2. The contract between us and you the purchaser

  • Your order will be acknowledged by confirmation email. The email will also confirm details of your order, and despatch date. This is when our contract with you is made.

  • Terms may change. The terms that apply to you are those here on our site on the day you place your order

  • If any of the goods you order are unavailable you will be able to cancel the order and receive a full refund

  • If you are owed money by us for this or any other valid reason, your Paypal Account will be credited as soon as practicable, but no later than 7 days from the order date

3. Your details

  • You must supply us with accurate and up to date information about yourself, to enable us to deliver your goods

  • We will try to respond to any dissatisfaction you have, as long as you contact us within 14 Days of your purchase

4. Price and Payment

  • The full price of your order must be paid before we can despatch any part of it. Delivery charges will be borne by us for delivery in the UK. For overseas delivery please contact us by email to get a price for delivery - prior to ordering.

  • You will be responsible for any charges relating to a payment made in a currency other than pounds sterling

5. Delivery

  • Paintings will be despatched within 3 working days from date of order. The carrier will deliver to the address given in your order. Someone must be there to accept the delivery. We will provide details of the carrier and the online tracking details of the order.

  • If we are unable to make delivery within 7 days of your order date, you will be notified by email to arrange another delivery date

  • The goods may be delivered in instalments if not all the goods are available at the same time

6. Returns and Refunds

  • You are buying goods by mail order, you therefore have a right of cancellation. If you do, the following terms apply;

  • If you wish to cancel, you must inform us within 7 days of the receipt of your goods

  • You may not cancel orders for specially commissioned goods done to your specification.

  • The goods must be returned to us  within 21 days with both goods and packaging undamaged

  • The goods must be securely wrapped and include our delivery slip

  • The goods are returned at your risk and cost.

  • When we receive the goods we will credit your Paypal Account  with the full purchase price

  • If the goods are not returned you are liable to us for the cost

  • We are not obligated to collect goods from you, but if we do, you must pay the costs

  • Ordered commissions cannot be returned.

7. Disclaimers

  • We may make changes to our web site, the contents of the site, or the goods, at any time without prior notice

  • Content may include technical inaccuracies

  • We reserve the right to refuse any order for whatsoever reason

  • We give no warranty as to;

  • The adequacy of the goods for your purpose

  • Any implied warranty or fitness of goods for a particular purpose

  • Our liability in any claim against us is limited to the value of the goods purchased

8. Property Titles

  • Title and ownership rights shall remain with us until Payment in Full is received.

  • You may not copy, reproduce, modify, or in any way exploit any of the content. Copyright remains with us.

9. Contractual Limitations

  • When goods are provided without a charge, they are not to be associated with any service for which a charge is made. There is, therefore, no obligation on us in respect of such goods

10. Rights of third parties

  • Nothing in this agreement or on our web site shall confer on any third party any benefit under the provision of the Contracts (Rights of Third Parties) Act 1999

11. Force majeure

  • We will not be liable for a breach of our obligations arising from something beyond our reasonable control, for example, strikes of our employees

12. Dispute Resolutions

  • In the event of any dispute arising from these terms, or any contract between you and us, you will attempt to settle such dispute with us in a process of mediation, before commencing litigation

13. Governing Law

  • This agreement shall be governed and construed in accordance with the law of England only

Note:

  • In compliance with the Privacy and Electronic Communications Act we do not send random marketing emails to personal email addresses (spam).

  • WE conform to the requirements of the DataProtection Act, 1998.
